| FOX MOTO RENT TERMS & CONDITIONS Rental Terms & Conditions Fox Moto Rent is a subsidiary of Fox Kustoms Inc. REQUIREMENTS FOR A MOTORCYCLE RENTAL You must be at least 25 years old. You must have a valid motorcycle class driver’s license You must have a major credit card that matches your drivers license. International renters must also provide passport that matches drivers license and credit card as well as drivers license recognized by ICBC. No driving under influence of drugs or alcohol. DOT helmet must be warn at all times when on bike even if stopped. Must be at least this tall to ride (depends on bike) Cancellations due to not meeting the requirements of the rental is the responsibility of the renter and non refundable. (Forget license? Not 25? No rental, no refund, we could have rented it to someone else that day). WHAT IS INCLUDED IN THE RENTAL RATE 300 KM’S PER DAY. Millage rates can be negotiated for long tours. Use of vehicle for a 24 hour period per rental day purchased Prolly some bad jokes CUSTOMER ORIENTATION Every client will receive basic operational rundown on bike but it is the renters responsibility to find the owners manual online and read it prior to rental to absolve us of liability so you don’t sue us. STORAGE FOX MOTO RENT Can provide storage for client luggage, airline tickets, and other valuables free of charge, however at clients’ risk. We also have a locked compound that locals cars can be secured in for duration of rental at no charge but at renters own risk. FUEL Fuel costs are client’s responsibility. FOX MOTO RENT claims no responsibility for motorcycle fuel consumption and mileage. You may prepay for fuel refill. If prepaid fuel is not purchased and vehicle needs refueling, $40 CND charge will be added. ADDITIONAL DRIVERS additional driver is permitted at extra charge of 25 dollars per rental. The minimum age for an additional driver is 25 and a valid motorcycle license is required. MAINTENANCE RESPONSIBILITY The customer is responsible for checking tire pressures chain tension and engine oil levels at beginning of each ride and reporting mechanical issues/failures immediately. Instructions and procedures for maintenance expense reimbursement are provided at pick-up. Customers may be held responsible for mechanical damage due to negligence in motorcycle operation or failure to provide normal maintenance. SECURITY DEPOSIT A security deposit will be taken at pick-up and must be processed via valid credit card. Security deposit with purchase of damage waiver is 2000.00 Security deposit without damage waiver is 5000.00 Security deposit will be refunded after motorcycle is returned and inspected and found to be undamaged and without any extra costs incurred. Please reference the Waiver Coverage section for more details. RESTRICTIONS Violation of listed restrictions voids Damage Waiver and the client will be held liable for damages and costs incurred. Motorcycles are for on road use only, the roads do not have to be paved, but they have to be roads covered by ICBC insurance. Not to be ridden on trails, private land, beaches, off sweet jumps, single track, water crossings, in the oceans or lakes, in rivers and creaks, down boat ramps, on sidewalks or behind gated areas. Unfortunately you also cannot use the bike lanes or bike paths either as those are only for the pedal-y kind of bikes. ABSOLUTELY NO RACE TRACK USE, NOT TRACK DAYS, NOT SKILLS COURSES, NO SUPERMOTO, NO ABANDON RACE TRACKS, NO MOTO CROSS, NO HORSE OR DOG TRACKS, NOT EVEN GO CART TRACKS. NOT EVEN PARKING LOTS WHEN CONES ARE PRESENT. Motorcycles must be ridden in a responsible manner and must follow all ICBC laws and speed limits. No burn outs! Tread depth is measured at the beginning and the end of each rental, bikes deemed to have excessive tire wear will be charged accordingly. MORE RESTRICTIONS Motorcycles not to be used for criminal purposes, including but not limited to; stunting, drive-by shootings, terrorist attacks, transporting drugs, hate crimes, prostitution, trespassing, acts of war, vandalism, assault, credit card fraud, bank robbery, kidnapping, tax evasion, excessive speed, identity theft, counterfeiting or DUI. Parades are OK. EXCESSIVE SPEED or DUI IMPOUND-if the rental bike gets impounded during rental period for any reason the renter will be responsible for the costs incurred by the impoundment including but not limited to towing, damage, storage/impound costs and will also be charged the daily rental rate for the rental unit at the full non discounted rate. Bikes must be returned with same parts they left with, no renting the bike and swapping parts with your own bike to upgrade. PARKING TICKETS AND TRAFFIC CAMERA INFRACTIONS Parking tickets and Traffic camera fines will be charged to the renters credit card plus an inconvenience fee of 100.00 OFF ROAD USE Nope, don’t do it. FLAT TIRES Flat tires are the responsibility of the renter as well as any costs and or damages incurred from incident. Check your tire pressure and ride responsibly, don’t ride through construction sites and avoid road hazards. We have contacts and suppliers all over so call us first if unfamiliar with the area and we can help you get help at a reasonable price. If a tire requires a full replacement we will refund a percentage of the tire replacement cost based on outgoing tread depth of tire as the new tire will obviously have more tread than original as long as tire is replaced with same brand model and size of tire or better. RESERVATION AND DEPOSITS All rental costs need to be paid in full at the time of booking, damage deposit taken at time of pick up. PICK-UP, RETURN and LATE CHARGES Pick-ups and drop offs are by appointment. One rental day is based on a 24-hour rental period starting from the time of pick-up. No refunds for early motorcycle returns are granted. APPOINTMENTS ARE AVAILABLE BETWEEN 9AM AND 5PM BUT APPOINTMENTS CAN BE MADE OUTSIDE THESE HOURS IN MOST CASES WITH AN EXTRA FEE OF 40 DOLLARS TO COVER OVERTIME COSTS. Late Charge: A $50 per hour penalty is assessed if the motorcycle is returned late from scheduled drop off time. CANCELLATION AND REFUNDS All reservations are final and non-refundable. A reservation may be cancelled up to 30 or more days prior to the pick-up date with no cancellation penalty, and with the contracted amount issued in the form of a Store Credit that can be redeemed within 1 year from the date it was issued. 30% of the total will be applied towards cancellation fee if the booking is canceled between 30 – 21 days from pickup time. 60% of the total will be applied towards cancellation fee if the booking is cancelled between 20 – 11 days from the pick-up time. 100% of the total will be applied towards cancellation fee if the booking is cancelled within 10 days from pickup time or if the customer does not show up. Any and all balances remaining after Cancellation Fees have been applied will be issued in the form of a Store Credit that may be redeemed within one year. Requests for refunds will be reviewed by Fox Moto Rent Customer Service, and will be at the sole discretion of the company. Please note: A $25 admin fee will be applied to a reservation that is modified between 30 – 11 days before pick-up time. STORE CREDITS Store credits owned by an individual may only be used for reservations booked by and for that specific individual. Store Credits can be used once per payment (So once during booking, and multiple during subsequent payments). Store Credits expire 1 year after the issuing date. Store credits can only be applied at locations within the same country as the original booking. PAYMENT METHODS Fox Moto Rent accepts the following methods of payment: Cash, VISA, Master Card, E Transfer and Debit (also maybe interesting trades) BOOKING TERMS Reservation must be paid in full to guarantee rate and rental date. Reservations are non-refundable. We reserve the right to substitute another bike under extenuating circumstances such as bikes getting impounded or stolen. We will do everything we can to get you out on your bike of choice and don’t ever double book but sometimes things can happen. DAMAGE WAIVER COVERAGE All Theft and Damage Waivers are subject to the express terms and conditions of the rental contract and do not include coverage for injury, personal property, or damage as the result of negligence such as illegal use or use of rental while under the influence of drugs or alcohol. A Police Report is required for all damages or accidents. All damages to rented motorcycle without a police report will be considered to be at the fault of the Renter. If motorcycle is damaged during a rental the renter can pay the 1000 dollar deductible to use the Damage waiver to cover repair costs. Renter is responsible for all damage to bike during rental period even if they are not with bike when damage occurs. This includes damage from vandalism attempted theft, successful theft, bike falling over for any reason, bad motorcycling, acts of God, acts of tourism, acts of war, acts of aliens and ghosts, bad luck and negligence. Terms, Conditions, Liability: In addition to agreeing to these terms at checkout, you will be required to sign a paper copy when you pick up your equipment. I accept full financial responsibility for the equipment i have rented. I promise to return it clean, dry, and undamaged by the agreed date and time. If I fail to do so, I will pay for it’s repair, cleaning, drying, or replacement at the full retail rate, as determined by Fox Moto Rent. If the items are returned late, I agree to pay for the additional days at the I understand that there are inherent, and other, risks involved in the activities for which this equipment is to be used. I freely assume those risks including the risk of serious injury or death. I agree to release, hold harmless, and indemnify Fox Moto Rent. the makers and distributors of the equipment, and their owners, agents and employees from any and all liability for damage and injury to myself or to any person or property resulting from any cause including negligence, the selection, adjustment, and use of this equipment. Fox Moto Rent. provides no warranties, expressed or written. I accept for use as is the equipment listed on this form and accept full responsibility for the care of the equipment. I will be responsible for the replacement at full retail value of any equipment rented under this agreement but not returned to Fox Moto Rent, and will reimburse Fox Moto Rent for any loss or damage other than reasonable wear and tear. I will return all rental equipment by the agreed date in clean condition to avoid any additional charges. I agree that it is my responsibility to know how to properly use and operate the equipment and obtain necessary instruction. I understand the function of, and I will not misuse or abuse, the equipment. I am legally competent to sign this agreement and 18 years of age or older. I HAVE CAREFULLY READ THIS RENTAL AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS RELEASE OF LIABILITY IS A BINDING CONTRACT AND I AGREE TO IT OF MY OWN FREE WILL |
